MOPED SCOOTER RENTAL TERMS AND CONDITIONS

Use of the moped scooter

The Lessee shall take care of the moped scooter in a way a caring owner takes care of their property. The Lessee shall drive very carefully and shall be very attentive.
The moped scooter can be driven exclusively by the Lessee. The possession of the moped scooter may be given over to another person and the moped scooter may be driven by another person only provided it is specifically permitted in the rental agreement.
The moped scooter may not be used for illegal purposes, races or training. In addition the moped scooter may not be used for driving lessons without a special agreement.
The moped scooter and its accessories shall be properly locked in the parking lot. The scooter shall be locked with a steering wheel lock and in addition one of the wheels shall be locked with a U-lock and the other wheel with a cable lock to a suitable permanent structure.
During the process of giving the moped scooter over to the Lessee, both parties shall check visually the condition of the scooter, equipment and locks in order to avoid later disputes regarding the time one or another damage has occurred. Possible detected damages shall be noted in the agreement.

Liability for the moped scooter and equipment during the rental period

General Lessee’s deductible

Within the upper limit of deductible specified in the agreement, the Lessee shall be obliged to act as follows:

In case of theft to reimburse the cost of the moped scooter and damages caused to the moped scooter, its equipment and rental equipment caused during the rental period;

To reimburse the missing parts and additional equipment of the moped scooter or equipment.

If applicable, deductible shall be collected after the vehicle has been inspected and repaired.

Responsibility of the Lessee for any damages

In case damages to the moped scooter are caused by driving the vehicle under the influence of alcohol or any other intoxicating agent or the Lessee has in any other way infringed essential terms and conditions of this contract, the Lessee undertakes to reimburse fully to the rental company also other related costs, for instance, court costs and collection costs.

Exemption of the Lessee from the obligation to pay compensation

The Lessee shall be exempted from the obligation to pay compensation in case the rental company receives full compensation based on the traffic insurance or from the party having caused the damage.

Other payment obligations

The Lessee shall assume all costs and expenses related to speeding and other traffic and parking fines including all possible additional costs accumulated during the rental period.

Rental amount, deposit and additional fees

The rental amount and possible rental amount for renting an additional helmet shall be paid in cash upon receiving of the moped scooter and additional equipment. Besides the moped scooter, the rental amount includes one helmet and U-lock/cable lock.
The deposit shall be paid in cash upon renting the moped scooter. The deposit shall be returned to the Lessee after the moped scooter and its additional equipment have been returned and the representative of the rental company has inspected and accepted these.
Possible additional fees, for instance compensation for exceeding the rental period or mileage shall become payable according to the agreement after the scooter has been returned.

Fuelling and maintenance of the scooter

The Lessee is obliged to return the scooter it´s fuel tank filled with fuel 98 (or 95E) . The Lessee shall be responsible for the damages caused by using wrong fuel. The Lessee shall be responsible for taking care of regular inspection of the scooter, for instance for monitoring the engine oil level, tyre pressure, etc.

Actions to be taken by the Lessee in case of failures, damages and theft

The Lessee shall immediately notify the rental company about the damages detected or occurred on the moped scooter or about the theft of the scooter. In case of theft, also a written report shall be made to the police. Thereafter the rental company shall inform the Lessee about further measures to be taken regarding the incident.
In the event of a traffic damage, the Lessee is always obliged to present a loss report to the rental company. To inform VibuViis OÜ about the incident, call +372 580 19 237. In case the guilty party is not clear, the Lessee shall also inform the police. The police shall always be reported in case of injuries. The Lessee is obliged to note down the personal data and contact data of the parties and witnesses of the traffic damage and their own explanations regarding the incident and to present these to the rental Company.
In case the Lessee fails to submit the above mentioned report, they shall be personally responsible for the caused damage.

Returning of the moped scooter in the end of agreed rental period

In the end of the rental period stated in the contract, the moped scooter shall be returned to the agreed place. Any changes in the return date or place shall be agreed sufficiently early with the rental company. The rental period in accordance with the contract ends when the moped scooter and its additional equipment has been returned and accepted by the employees of VibuViis OÜ.
In case the moped scooter has not been returned in the end of the rental period and prolonging of the rental period is not agreed with the rental company, the police will be informed.
In case the Lessee fails to fulfil their obligations stated in article 1, the rental company has a right to request reasonable compensation for the economic losses it causes to the rental company.

Termination of the agreement

VibuViis OÜ has the right to terminate the agreement during the rental period in case it appears that the Lessee commits a serious breach of this agreement or in case in the opinion of the rental company the Lessee is not able to use the moped scooter as required. In case the rental company terminates the agreement, the Lessee shall be obliged to return the scooter together with the equipment to the rental company without any delay. It is not permitted to take the scooter outside of the borders of the Republic of Estonia.

I confirm that I will not drive the moped scooter under the influence of alcohol or any other intoxicating agent and that I have the right to drive a scooter in Estonia. I am aware of the fact that according to the Traffic Act of Estonia, the alcohol content in the breath exhaled by the driver must be 0 permille.

In case the moped scooter has not been returned in the end of the rental period and prolonging of the rental period is not agreed with the rental company, the police will be informed.

In case the Lessee fails to fulfil their obligations stated in article 1, the rental company has a right to request reasonable compensation for the economic losses it causes to the rental company.
